Agreement Terms for Photographic Services

This agreement establishes that the Photographer is acknowledged as the sole Author of the commissioned works produced, retaining complete ownership of the copyright to these works in all regions of the world. The Client is granted a specific License to Use the photographs, which permits only the usages explicitly described. It is important to note that no additional rights beyond those expressly conveyed in this License are conferred to the work(s).
Payment Conditions

This License is contingent upon the Photographer receiving full payment within the timeframe agreed upon by both parties. All rights not explicitly granted to the Client remain solely with the Photographer. Furthermore, the Client is prohibited from transferring or assigning this License to any third party without the written consent of the Photographer.
Approval Process

The Client must approve all images during the shoot itself. If, for any reason, any images are rejected after the shoot has been completed, the Client will still be obliged to pay the full amount specified in the invoice based on the final Cost Estimate. It is crucial to understand that no License, as described in clause 1 of this agreement, will be granted for rejected images, even if the payment for the services has been made.
Additional Expenses

If the Photographer incurs additional expenses due to modifications to the original brief provided by the Client or due to unforeseen circumstances beyond the Photographer’s control, the Client agrees to cover these additional reasonable expenses and/or fees according to the Photographer’s standard rates.
Acceptance of Terms

The initiation of the photo shoot signifies the Client’s acceptance of the final Cost Estimate in its entirety and the mutual agreement to the terms outlined herein. This Agreement serves as the complete and exclusive record of the relationship between the parties, superseding any prior agreements.
Credit Line for Editorial Use

For images used for editorial purposes, the Client agrees to provide proper attribution to the Photographer. This must be done in a font size no smaller than the nearest text and positioned immediately next to the utilized image. If this credit is not provided, the editorial fee will be converted to a full commercial fee.
Indemnification Clause

The Client agrees to indemnify and defend the Photographer from all liabilities, claims, or legal expenses that may arise from the Client’s usage of the photographs.
Usage Rights

The Photographer retains the rights to utilize the photographs in any capacity, at any time, and in any location worldwide for self-promotional purposes, showcasing their work.
Breach of Agreement

In the case of non-payment or any breaches of this agreement by the Client, the Client shall be responsible for all costs and expenses incurred by the Photographer in the enforcement of this agreement, including attorney’s fees. Under such circumstances, the License described in clause 1 will become void and unenforceable.
Modification of Terms

No alterations to the terms of this contract will be recognized unless they are documented in writing and agreed upon by both parties.
Governing Law
-
This agreement shall be governed by and construed by the laws of the Republic of South Africa.
Interest on Overdue Accounts

An interest rate of 2.5% per month will be applied to all overdue accounts.
Pricing Information

Please note that the listed basic packages are only starting points for all custom packages. Prices are subject to change without prior notification due to various factors.
Variable Investment Requirements

The investment required for each quote may fluctuate due to economic factors, including but not limited to inflation, fuel prices, and rental equipment fees.
Equipment Upgrades
-
In cases where equipment upgrades are necessary, CozarPhotography reserves the right to adjust the booking fees accordingly to reflect these changes.
Booking Terms & Conditions
**NOTICE:** For the Ceremony Packages, all deposits are required to be submitted at least three weeks before the scheduled date of the commissioned work. This deposit is essential to cover the logistics necessary for the successful execution of the event.

The deposit serves to secure the date(s) and time(s) of your booking for the commissioned work. Any agreement will become null and void without a minimum deposit of 20% received at least two weeks before the scheduled date. In the absence of this deposit, the full payment for the package must be settled upon the Photographer's arrival at the venue on the day of the event. Adhering to this payment schedule is imperative.

Cancellations must be communicated at least 2 weeks prior to the commissioned date. A maximum refund of 30% will be provided if the full amount has been paid for the commissioned work. Refunds will not be considered within fourteen days preceding the event, except in cases such as death or changes to the event's date. In these instances, a 30% fee will still apply due to prior arrangements and logistics already incurred by the Photographer.

Payment and settlement terms are negotiable with the Photographer; however, the client shall not receive all services outlined in the agreement or chosen package until the complete payment is settled.

The Photographer should be allocated a minimum of 45 - 60 minutes for a session with the couple and the bridal party.

To ensure a seamless experience and optimal photographic results, guests and individuals using mobile devices must not in any case obstruct the Photographer's field of view. If such obstructions occur, the Photographer may produce images featuring individuals who are partially or fully blocking the intended view.

All guests, special items, and accessories must be coordinated in advance with the Photographer. Prior notification regarding any specific photographs that are desired should be provided before the event.

It is important to note that the Photographer cannot be held responsible for photographs that cannot be captured or provided due to misplaced items or guests inadvertently moving out of frame when the Photographer intends to photograph them.

By accepting this invoice, the client acknowledges that the Photographer is engaged solely for the agreed-upon timeframe. The client is responsible for ensuring that all events transpire punctually.

Upon notification from the Photographer that the agreed duration has concluded, only the photographs taken within that period will be submitted. This may result in a lesser number of images than the maximum specified in the selected package.

Furthermore, the client acknowledges that should the event exceed the scheduled time, any additional paid extension does not guarantee a greater number of photographs than indicated in the chosen package. Delays caused by late arrivals of clients or guests, power outages, decor preparations, etc., shall not be accepted as valid justifications for extending the time allocation with the Photographer. The Photographer shall adhere strictly to the agreed timeframe. For instance, if the Photographer is booked from 12:00 PM to 3:00 PM, they will cease shooting or depart at 3:00 PM, irrespective of delays, unless the client consents to and compensates for the additional time.
